    Are real estate agents in Spain obliged to perform KYC?

    Yes. Under Ley 10/2010 and Real Decreto 304/2014, real estate agents are obliged subjects and must apply customer due diligence (CDD), keep records and report suspicious activity to SEPBLAC. Working with a lawyer or notary does not remove the agent's own AML obligations.

    What KYC documents should an agent collect from a property buyer?

    At minimum: government-issued ID (passport or DNI/NIE), proof of address, beneficial ownership for corporate buyers, source-of-funds evidence (salary, sale of asset, inheritance, business income), and Enhanced Due Diligence documentation for PEPs and high-risk clients.
